When a legal matter affects your family, it’s naturally a serious matter, and such cases are generally guided by family law. Family law is an important arm of our legal system that is designed to protect the rights of parents and children alike. Discuss your family law case or concern with an experienced Oakland County family law attorney today.
Many people equate family law with divorce, but there is actually much more to this branch of the law than that. Consider the following:
A primary and often heated term of divorce (in any divorce involving shared children) is child custody. In Michigan, child custody is divided into both legal and physical custody, which includes parenting time. Legal custody bestows the right to make important decisions in your children’s lives, and you and your children’s other parent can either share this responsibility, or one of you can become the sole legal custodian. Alternatively, one of you may have the authority to break a tie if it becomes necessary (if you share legal custody), or you may divide this important responsibility between you according to the category of decision that is being made, including:
Physical Custody sets the schedule whereby you and your children’s other parent will divide your time with them. If one of you becomes the primary custodial parent (who has the children the majority of the time), the other will receive a parenting time schedule (what you may think of as a visitation schedule). Otherwise, you will divide your parenting time more evenly between both of you.
Child support is determined according to the state’s exacting calculation methodologies. While many factors are involved in the process, the parent who is the higher earner typically has the child support obligation (even if parenting time is divided evenly).
Dividing your marital assets (those things of value that you acquired over the course of your marriage) between you equitably – or fairly – is another important divorce term that has the potential to become exceptionally challenging.
Alimony is a term of divorce that only plays a role when the divorce itself leaves one spouse unable to continue supporting himself or herself financially. If the other spouse has the financial means to offset this economic downturn, alimony may be set.
