Some divorce cases can be resolved relatively quickly, while others might take months before your marriage is legally dissolved. One important factor that can help is having the representation of an Oakland County divorce attorney.

Getting Divorced in Oakland County, Michigan

Divorce is a legal process that formally dissolves a marriage. One spouse petitions the court to end the marriage, and the process begins. In Michigan, you do not have to prove that your spouse engaged in misconduct to get a divorce. Instead, you must cite the no-fault ground that there was a breakdown of the marriage, and there is no reasonable likelihood that the marriage can be preserved. However, be aware that misconduct may come into play throughout the divorce case in certain situations.

You can file for divorce in Michigan as long as one spouse has lived in our state for 180 days, and one spouse has lived in the county where you are filing for at least ten days. Once the process begins, the non-filing spouse has a short time – typically 21 days – to respond to the complaint. If you receive notice of a divorce filing, swift action is necessary.

Common Issues in a Divorce

The law requires you and your spouse to resolve certain issues before the court will issue a final divorce judgment. These issues will depend on your circumstances and can include:

Some couples are able to agree on how to resolve these complicated matters from the start. Others need the assistance of their attorneys for negotiation or mediation to reach an agreement. Some spouses are unable to compromise out of court, and they require litigation, in which they each present their case at trial, and the judge makes the decision for them. Our skilled legal team can assist with whatever process your divorce requires, and we know how to protect your rights and interests. We provide the representation you need during the divorce process.
